An High Court of Benue State sitting at Aliade has issued an Order of Interim Injunction, restraining Comrade Augustine Agada from acting, carrying out functions and parading himself as the Chairman of the All Progressives Congress (APC), Benue chapter.
This followed the determination of a Motion Ex-parte with Motion No: ALHC/08M/2024, dated 1st February, 2024 and filed by a chieftain Hon. Moses Agaba with Comrade Augustine Agada and the All Progressives Congress as 1st and 2nd Defendants respectively.
The court also issued an Order restraining the 1st and 2nd Defendants from taking any step(s) that may negatively affect the membership rights of the plaintiff, Hon. Agaba, pending the determination of the Motion on Notice.
In his affidavit in support of his Motion Ex-parte, Hon. Agaba Moses, adult, male, Christian and citizen of the Federal Republic of Nigeria resident at Otukpo Local Government Area of Benue State, claimed that he is a duly registered financial and up-to-date member of the APC.
He further claimed that as a member of the APC, he was aware of the contents of the party’s constitution and the fact the political party was built on justice, unity and progress.
The plaintiff further stated that on the 31st day of January, 2024, his attention was drawn to a correspondence from the Executive Committee of the party from Ehaje Ward 1, Owukpa, Ogbadibo LGA, addressed to the National Working Committee and the National Chairman of the APC and titled: “VOTE OF NO CONFIDENCE AND SUSPENSION OF BENUE STATE PARTY CHAIRMAN COMRADE AUGUSTIN AGADA”.
In further support of his Motion, Agaba stated that the Executive Committee of the APC in Ehaje Ward 1, upon the due consideration of a petition filed by the APC 2023 Senatorial Candidate for Benue South, Com. Daniel Onjeh, dated 22nd January, 2024 and addressed to the NWC and the National Chairman of the APC, found Comrade Agada to be guilty of working against the success of the party in his ward during the 2023 General Elections, amongst other infractions. He added that the Ehaje Council Ward Executive Committee consequently passed a Vote of No Confidence on Comrade Agada, and suspended him as a member of the APC with immediate effect. Nation
